Utah Code § 63A-19-402.5

The Utah Office of Tourism (UOT) is committed to protecting the privacy of individuals who access its website. This notice is designed to inform those accessing this website about what user data1 is collected, why it is collected, and how individuals can update and manage their personal data2 or user data.

II. Privacy Rights

By contacting UOT you may:

  • seek access to your personal data or user data;
  • request to correct or amend your personal data or user data; and
  • if you are an at-risk employee3, request that your personal data be classified as a private record.
III. Data Privacy Complaints

If you are concerned about the data privacy practices of a governmental entity, you may submit a complaint to the Data Privacy Ombuds at privacy.utah.gov/submit-a-complaint or by sending an email to privacyombudsperson@utah.gov.

IV. User Data Collected

Unless you choose to make your personally identifiable information available to UOT, UOT does not collect such information from you. For the purposes of this policy “personally identifiable information” means any information collected online that could serve to identify an individual, such as:

  • First and last name
  • Physical address
  • Email address
  • Telephone number
  • Social Security number
  • Credit card information
  • Account Number
  • Bank account information
  • Any combination of personal information that could be used to determine identity

Except where specified, you do not have to provide personally identifiable information to visit or download information from UOT’s websites. UOT does not use or place spyware on your computer. Be aware that government agencies may request personally identifiable information from you in order to perform requested specialized services.

The following non-personally identifiable information may be automatically collected and retained through the use of cookies or functionally equivalent technology if you look or search through UOT’s websites, download information, or interact with UOT’s advertisements:

  • The Internet domain and Internet Protocol (IP) address of the device you are using to access UOT’s website (such as a computer or mobile phone);
  • The type of browser and operating system used to visit UOT’s website;
  • The date and time of when you access UOT’s website;
  • Which portions of the website you visit;
  • General location data based on your IP address; and
  • Interactions with UOT’s advertisements.
V. Purposes and Uses

The data collected may be provided to third parties, as specified in this privacy policy. The data collected also serve as part of UOT’s statistical analysis about the use of its websites so UOT may better design online services and improve access to them, and help UOT monitor how effective its advertisements are at inspiring you to visit Utah. UOT does not attempt to gain personally identifiable information about individual users and associate it with IP addresses unless explicitly stated as part of a government agency service. UOT does not use the information automatically collected to ascertain your personally identifiable information. UOT may detect user IP addresses for providing location based user information and services and may disclose IP addresses to the third parties specified in this privacy policy, pursuant to the records sharing section in Utah Code § 63G-2-206(6)(b), which is a subsection of the Government Records Access Management Act (“GRAMA”).

Email or other information requests sent to the UOT website may be saved and used to respond to the request, forward the request to the appropriate agency, communicate updates to the UOT website that may be of interest to citizens, or provide the UOT web designer with valuable customer feedback to assist in improving the website.

Any personally identifiable information an individual provides to the UOT website will be used solely by UOT, its entities, and third party agents with whom it has contracted to perform a function on its behalf, unless the information is designated as a public record by an individual State agency as authorized under GRAMA, and UOT’s website provides conspicuous notice that such information is subject to public access.

Except as otherwise permitted by law, and pursuant to the Children's Online Privacy Protection Act (COPPA), UOT does not knowingly collect and use or disclose the personally identifiable information of a child under the age of 13.

VI. Sharing and Selling User Data

The classes of persons and entities with whom UOT shares user data includes:

Google AdWords/Doubleclick

The UOT uses Google AdWords and Google DoubleClick services. In addition to complying with the terms above, UOT complies with Google’s policy requirements

Google’s remarketing and similar audiences AdWords features permit UOT to reach people who previously visited its websites. Google’s interest categories, interest-based advertising, and demographic and location targeting features are similarly used to reach people who are likely to have interest in UOT advertising based on previous web searches. Google and its vendors display UOT advertising across the internet to IP addresses that have visited UOT websites.

Google’s DoubleClick service uses UOT ads to collect analytical data for planning purposes. The service does not collect personally identifiable information.

Google and its vendors use cookies to serve ads based on past visits to UOT’s website. A “cookie” is a small piece of information that a website can store in a designated file on your computer or Web-enabled device.  Cookies can be used, among other things, to identify your computer or device when you log into a website and may track your IP address in order to do so.

Managing Privacy

You have the ability to control the use of Certain Cookie Technologies. You may decline to receive interest-based ads through the ad vendor’s preferences tab. Digital ads have a small box in the top right corner of the ad. Clicking or tapping on this tab opens the ad vendor’s opt-out settings. Please note this does not stop you from being served advertisements. You will continue to receive generic advertisements.

Alternatively, you can opt out of a third-party vendor's use of cookies by visiting the Network Advertising Initiative opt-out page or, to opt out of only DoubleClick’s use of cookies, by visiting the DoubleClick opt-out page.

UOT does not use or associate personally identifiable information with remarketing lists, cookies, data feeds, or other anonymous identifiers. Furthermore, UOT does not use or associate targeting information, such as demographics or location, with any personally identifiable information collected from ads or their landing pages. UOT does not share any personally identifiable information with Google through its remarketing tags or any product data feeds which might be associated with its ads, nor does it send Google precise location information without obtaining your consent.

Opt-in and Opt-out Browsers

In addition, when you use the Site, you can change your web browser’s settings to reflect your cookie preferences for cookies directly from the site you are on or for third-party cookies. Each browser is different, but usually these settings are under the “options” or “preferences” menu.

Mailchimp

UOT partners with Mailchimp to send email communications. Where you have provided your consent to receive email communications, you can withdraw your consent to email marketing by using the unsubscribe link in any of our email communications.

Marketing Services

UOT partners with third-party service providers that may use various cookie technologies to gather anonymized and aggregated data to measure the effect our ads have in generating travel to Utah. These may include things such as the number of visitors who travel from a given city to Utah and which ads were most likely to reach travelers to Utah.

Non-State Websites                  

Visitors may link to various websites from UOT website pages. UOT is not responsible for the privacy practices or content of external sites. Many of these sites, particularly those in the private sector, may not be subject to GRAMA, other sections of the Utah Code, or federal law. Those visiting external sites are advised to check the applicable privacy statement and be cautious about providing personally identifiable information without a clear understanding of how the information will be used.

We want you to feel comfortable using our services, knowing that your privacy is respected and protected and we welcome your feedback on this notice, which is reviewed annually. This privacy policy may be changed at any time; any changes will be posted on this web page. Information collected while a particular version of this policy is in effect will be handled in accordance with that version.

1. “User data” means any information about a user that is automatically collected by a government website when a user accesses the government website. “User data” includes information that identifies:

  • a user as having requested or obtained specific materials or services from a government website;
  • Internet sites visited by a user;
  • the contents of a user's data-storage device;
  • any identifying code linked to a user of a government website; and 
  • a user's:
  • IP or Mac address; or
  • session ID. (Utah Code § 63A-19-101(38)).

2. “Personal data” means information that is linked or can be reasonably linked to an identified individual or an identifiable individual. (Utah Code § 63A-19-101(24)).

3. “At-risk government employee” means a current or former:

  • peace officer as specified in Section 53-13-102;
  • state or federal judge of an appellate, district, justice, or juvenile court, or court commissioner;
  • judge authorized by Title 39A, Chapter 5, Utah Code of Military Justice;
  • judge authorized by Armed Forces, Title 10, United States Code;
  • federal prosecutor;
  • prosecutor appointed pursuant to Armed Forces, Title 10, United States Code;
  • law enforcement official as defined in Section 53-5-711;
  • prosecutor authorized by Title 39A, Chapter 5, Utah Code of Military Justice; or
  • state or local government employee who, because of the unique nature of the employee's regular work assignments or because of one or more recent credible threats directed to or against the employee, would be at immediate and substantial risk of physical harm if the employee's personal information is disclosed. (Utah Code § 63G-2-303(1)(a)).
